Assembly Bill (AB) 2188

Assembly Bill (AB) 2188 , which amends the California Solar Rights Act, requires that, on or before September 30, 2015, every city must adopt an ordinance that creates an expedited, streamlined permitting process for small residential rooftop solar energy systems.  The purpose of the law is to further the State policy of promoting and encouraging the installation and use of solar energy systems by limiting obstacles to their use, and by minimizing the permitting costs of such systems.


The ordinance requires that the City adopt a checklist of all requirements with which small residential rooftop solar energy systems must comply to be eligible for expedited review.  Pursuant to AB 2188, the City must substantially conform its permitting process, including the checklist(s) and standard plans, with the most current version of the California Solar Permitting Guidebook. 


Small residential rooftop solar energy systems meeting certain criteria are eligible for an expedited permitting and inspection process.

Project types may include Solar Photovoltaic Systems, Solar Domestic Water Heating Systems, and Solar Pool Heating Systems


“Small residential rooftop solar energy system” means all of the following:

(A) A solar energy system that is no larger than 10 kilowatts alternating current nameplate rating or 30 kilowatts thermal.

(B) A solar energy system that conforms to all applicable state fire, structural, electrical, and other building codes as adopted or amended by the city.

(C) A solar energy system that is installed on a single or duplex family dwelling.

(D) A solar panel or module array that does not exceed the maximum legal building height as defined by the authority having jurisdiction.

Applications and submittals must contain all required eligibility checklists, forms, and use the required standard plan format.
